Terms of Service
The terms that apply when you book a package or use this site.
01 — Who these terms are between
These terms are an agreement between you ("you," "the client") and Design With Karl, operating from 1209 Marsalis Pl, Frederick, MD 21702, USA ("we," "us," "the studio"). By adding a package to your cart and completing checkout, or by engaging the studio for a project, you agree to these terms.
02 — What's sold
The studio sells fixed-scope, fixed-price digital design packages: Website Design & Build, Brand Identity Design, UI/UX Product Design, Website Redesign, and Design Systems & Style Guides, plus published add-ons and a monthly Design Care Plan. Current prices, scope, and turnaround for every package are published on /services/ and /pricing/ and form part of the agreement for any order placed against them.
03 — Ordering and the written scope
A package is booked when your deposit (or full payment) clears at checkout. Within 1 business day of booking, you receive a written scope document describing exactly what's included, what isn't, the project timeline, and the number of revision rounds. The written scope document — not this general Terms page — governs the specific boundaries of your project. If anything in your written scope conflicts with the general package description on the site, the written scope controls.
04 — Payment
Every one-off package offers two payment options: a 50% deposit now with the remaining 50% due on delivery (default), or 100% payment upfront for a 3% discount off the package price. The Design Care Plan is billed monthly in full. Prices are in US dollars. Maryland does not currently apply sales tax to the design services sold here; if that changes, the tax line at checkout will reflect it.
05 — Revisions
Two rounds of revisions are included in every package. A revision round means feedback on the current direction, incorporated into a next version for your review. Requests that meaningfully expand the original scope (new pages, new flows, a different deliverable than what was scoped) are not revisions — they're handled as a scope change, priced and agreed in writing before work continues.
06 — Intellectual property and ownership
Until final payment is made, all design work in progress remains the property of Design With Karl. On full and final payment, ownership of the final deliverables for your project transfers to you, along with full commercial rights to use them. Any brand assets, content, or materials you supply to the studio remain your property throughout. Design With Karl may, unless you request otherwise in writing, reference completed client work in its portfolio.
07 — Client responsibilities
You're responsible for supplying accurate information, timely feedback, and any assets or access the written scope identifies as needed from you. Delays on your side may extend the delivery timeline stated in your scope document; the studio will flag this as it happens.
08 — Cancellation and refunds

09 — Limitation of liability
The studio's total liability for any claim arising from a project is limited to the amount you paid for that specific package. Design With Karl is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities, arising from the use of delivered work. Nothing in these terms limits liability that cannot be limited under Maryland law.
10 — No warranty beyond the written scope
Deliverables are provided as scoped in your written scope document. Beyond what's explicitly included there, the studio makes no warranty — express or implied — about a specific business outcome (traffic, conversions, sales, or similar) resulting from the delivered design work.
11 — Acceptable use
You may not use this site to submit false information, attempt to circumvent the checkout or payment process, or misuse the contact form for anything other than a genuine enquiry.
12 — Governing law
These terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws principles. Any dispute arising from these terms or a project engagement is subject to the exclusive jurisdiction of the courts of Frederick County, Maryland.
13 — Changes to these terms
Terms may be updated from time to time; the version in effect at the time you place an order governs that order. The "Last updated" date below reflects the most recent revision.
